I.WHATTHISWARRANTYCOVERSANDFORHOWLONG:
MOTOROLASOLUTIONS,INC.(“MOTOROLA”)warrantstheMOTOROLAmanufacturedCommunication
Productslistedbelow(“Product”)againstdefectsinmaterialandworkmanshipundernormaluseandservicefora
periodoftimefromthedateofpurchaseasscheduledbelow:
KVL4000KeyVariableLoaderOne(1)Year
ProductAccessoriesOne(1)Year
MOTOROLA,atitsoption,willatnochargeeitherrepairtheProduct(withneworreconditionedparts),replace
it(withaneworreconditionedProduct),orrefundthepurchasepriceoftheProductduringthewarrantyperiod
provideditisreturnedinaccordancewiththetermsofthiswarranty.Replacedpartsorboardsarewarrantedfor
thebalanceoftheoriginalapplicablewarrantyperiod.AllreplacedpartsofProductshallbecometheproperty
ofMOTOROLA.
ThisexpresslimitedwarrantyisextendedbyMOTOROLAtotheoriginalenduserpurchaseronlyandisnot
assignableortransferabletoanyotherparty.ThisisthecompletewarrantyfortheProductmanufacturedby
MOTOROLA.MOTOROLAassumesnoobligationsorliabilityforadditionsormodicationstothiswarranty
unlessmadeinwritingandsignedbyanofcerofMOTOROLA.Unlessmadeinaseparateagreementbetween
MOTOROLAandtheoriginalenduserpurchaser,MOTOROLAdoesnotwarranttheinstallation,maintenance
orserviceoftheProduct.
MOTOROLAcannotberesponsibleinanywayforanyancillaryequipmentnotfurnishedbyMOTOROLAwhich
isattachedtoorusedinconnectionwiththeProduct,orforoperationoftheProductwithanyancillaryequipment,
andallsuchequipmentisexpresslyexcludedfromthiswarranty.BecauseeachsystemwhichmayusetheProduct
isunique,MOTOROLAdisclaimsliabilityforrange,coverage,oroperationofthesystemasawholeunderthis
warranty.
II.GENERALPROVISIONS:
ThiswarrantysetsforththefullextentofMOTOROLA'sresponsibilitiesregardingtheProduct.Repair,replacement
orrefundofthepurchaseprice,atMOTOROLA'soption,istheexclusiveremedy.
THISWARRANTYISGIVENINLIEUOFALLOTHEREXPRESSWARRANTIES.IMPLIEDW ARRANTIES,
INCLUDINGWITHOUTLIMITA TION,IMPLIEDW ARRANTIESOFMERCHANTABILITYANDFITNESS
FORAPARTICULARPURPOSE,ARELIMITEDTOTHEDURATIONOFTHISLIMITEDWARRANTY .IN
NOEVENTSHALLMOTOROLABELIABLEFORDAMAGESINEXCESSOFTHEPURCHASEPRICE
OFTHEPRODUCT,FORANYLOSSOFUSE,LOSSOFTIME,INCONVENIENCE,COMMERCIALLOSS,
LOSTPROFITSORSA VINGSOROTHERINCIDENTAL,SPECIALORCONSEQUENTIALDAMAGES
ARISINGOUTOFTHEUSEORINABILITYTOUSESUCHPRODUCT,TOTHEFULLEXTENTSUCHMAY
BEDISCLAIMEDBYLAW.
