allowtheexclusionofimpliedwarranties,sotheaboveexclusionmaynotapplytoyou.
13.Remedies
TheentireliabilityofMotorola,andyourexclusiveremedyunderthewarrantyprovidedinthisAgreementwillbe,
atMotorola'soption,torepairorreplaceanyMediafoundtobedefectivewithinthewarrantyperiod,ortorefund
thepurchasepriceandterminatethisAgreement.Toseeksucharemedy,youmustreturntheentireProductto
Motorola,withacopyoftheoriginalpurchasereceipt,withinthewarrantyperiod.
14.LimitationofLiability
THETOTALLIABILITYOFMOTOROLAUNDERTHISAGREEMENTFORDAMAGESWILLNOT
EXCEEDTHETOTALAMOUNTPAIDBYYOUFORTHEPRODUCTLICENSEDUNDERTHIS
AGREEMENT.INNOEVENTWILLMOTOROLAORANYOFTHELICENSORSBELIABLEINANYWAY
FORINCIDENTAL,CONSEQUENTIAL,INDIRECT,SPECIALORPUNITIVEDAMAGESOFANYNA TURE,
INCLUDINGWITHOUTLIMITA TION,LOSTBUSINESSPROFITS,ORLIABILITYORINJURYTOTHIRD
PERSONS,WHETHERFORESEEABLEORNOT,REGARDLESSOFWHETHERMOTOROLAHASBEEN
ADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES.THELIMITATIONSINTHISPARAGRAPHWILL
APPLYNOTWITHSTANDINGANYFAILUREOFESSENTIALPURPOSEOFANYLIMITEDREMEDY .
Somejurisdictionsdonotpermitlimitationsofliabilityforincidentalorconsequentialdamages,sotheabove
exclusionsmaynotapplytoyou.
15.U.S.Government
IfyouareacquiringtheProductonbehalfofanyunitoragencyoftheU.S.Government,thefollowingapplies.Use,
duplication,ordisclosureoftheProductsissubjecttotherestrictionssetforthinsubparagraphs(c)(1)and(2)ofthe
CommercialComputerSoftwareRestrictedRightsclauseatFAR52.227-19(JUNE1987),ifapplicable,unless
beingprovidedtotheDepartmentofDefense.IfbeingprovidedtotheDepartmentofDefense,use,duplication,
ordisclosureoftheProductsissubjecttotherestrictedrightssetforthinsubparagraph(c)(1)(ii)oftheRights
inTechnicalDataandComputerSoftwareclauseatDFARS252.227-7013(OCT1988),ifapplicable.Software
andDocumentationmayormaynotincludeaRestrictedRightsnotice,orothernoticereferringspecicallyto
thetermsandconditionsofthisAgreement.ThetermsandconditionsofthisAgreementwilleachcontinueto
apply,butonlytotheextentthatsuchtermsandconditionsarenotinconsistentwiththerightsprovidedtoyou
undertheaforementionedprovisionsoftheFARandDFARS,asapplicabletotheparticularprocuringagencyand
procurementtransaction.
